Terms of Service

Last updated: [date]

These terms govern your use of Hydrometric, including the website at hydrometric.io, the Hydrometric application, and the Hydrometric API and MCP interfaces (together, the "Service"). Please read them carefully. By creating an account or using the Service you agree to them.

1. Who we are

The Service is provided by Aegaea Ltd ("we", "us"), a company registered in England and Wales under company number [company number], whose registered office is at [registered office]. You can contact us at community@hydrometric.io.

2. Who can use the Service

The Service is designed for professional use by hydrologists, engineers, consultants, researchers and students. You must be at least 18. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these terms for it, and "you" includes that organisation.

3. Your account

  • You sign in with your email address and a one-time code. Keep access to your mailbox secure; anyone who can read it can sign in as you.
  • An account is for one person. Do not share your account or API keys.
  • You must give accurate details, including in your profile, which appears on your reports and sign-offs.
  • The free allowance is one per person. Creating extra accounts to obtain more free assessments is not allowed.

4. Plans, prices and payment

  • Free. New accounts include one assessment free of charge. Existing account allowances are preserved. This is a one-off allowance for the life of the account; it does not reset.
  • Basic. Statistical analysis, audit trail, reporting and external review for £35 per user per month or £385 per user per year. The subscription renews automatically at the end of each period until you cancel it.
  • Method Space and automated access. Method Space in the web app is included in Basic and Advanced. Advanced remains coming soon. The planned launch arrangement for automated API and MCP access is a separate prepaid API balance, distinct from per-catchment purchase credits. Availability and activation remain pending. [Before launch, confirm the API rates, usage limits and treatment of failed runs; do not infer them from legacy Method Space run-credit prices.]
  • Prices are in pounds sterling and are exclusive of VAT. Founding customer and team prices are listed on our Pricing page; contact us to arrange these before checkout.
  • Payments are processed by Stripe. By subscribing you authorise us, through Stripe, to charge your payment method for each renewal.
  • We may change our prices. We will give you at least [30] days' notice before a change affects your subscription, and you may cancel before it takes effect.

5. Cancellation and refunds

  • You can cancel your subscription at any time by emailing community@hydrometric.io from the address on your account. [Update if a self-service cancellation option is added.]
  • Cancellation takes effect at the end of the current billing period. You keep your paid-plan access until then. We do not refund part-used periods except where the law requires it.
  • Unused Method Space credits are [refundable / non-refundable] [on request within [period]].
  • [Reviewer to confirm whether consumer cancellation rights (the 14-day cooling-off period) need to be addressed for users who are not acting for a business.]
  • We may suspend or close your account if you seriously or repeatedly break these terms, or if payment fails and is not put right within [14] days.

6. Engineering outputs and professional responsibility

This section matters. Please read it.

  • Hydrometric produces hydrological estimates, not certified answers. The results depend on the data, the methods and the choices made, and every estimate carries uncertainty.
  • All outputs must be checked by a competent hydrologist before they are relied on for design, planning, regulatory submissions, flood risk assessments or any other decision. Professional responsibility for how an output is used stays with you and your organisation at all times.
  • You are responsible for the inputs you provide, the descriptors and values you override, the methods and estimates you adopt, and any report or sign-off you issue.
  • The Service relies on third-party datasets and published methods, which may contain errors, may be revised, and may not suit every catchment. We do not guarantee that any output is accurate, complete or fit for a particular purpose, or that it matches the results of any other software.
  • Features labelled beta, preview or research are experimental and may change or be withdrawn.

7. Acceptable use

You must not:

  • use the Service unlawfully, or to infringe anyone's rights;
  • try to gain unauthorised access to the Service, other accounts or our systems, or interfere with their operation, including by excessive automated requests or load testing;
  • copy, scrape or bulk-extract datasets from the Service beyond normal use of its features and the API allowances;
  • reverse engineer the Service except where the law allows;
  • get around plan limits, allowances or rate limits;
  • upload malicious code, or content you do not have the right to use;
  • resell or provide the Service to others except as we have agreed in writing.

8. Your content

  • You own the data, files, analyses, reports and comments you put into or create with the Service ("your content").
  • You give us a licence to host, copy, process and display your content only as needed to run the Service for you and the people you share it with.
  • If you opt in to data sharing, you also give us a licence to use the anonymised summary described in our Privacy Policy to build and publish aggregate evidence on method choices.
  • You are responsible for having the right to upload your content, including any personal data about other people.
  • If you give us feedback or suggestions, we may use them without any obligation to you.

9. Our intellectual property and third-party data

  • The Service, its software and the Hydrometric name and branding belong to Aegaea Ltd or its licensors. We give you a personal, non-exclusive, non-transferable right to use the Service under these terms while your account is active.
  • The Service includes third-party data used under licence, including the NRFA Peak Flow Dataset (© UK Centre for Ecology & Hydrology, used under the NRFA data terms), Environment Agency data (© Environment Agency copyright and/or database right, under the Open Government Licence v3.0), SEPA data (© Scottish Environment Protection Agency), and map data from OpenStreetMap contributors and Esri. These remain owned by their licensors and are subject to their own terms. The full list of sources, licences and required attributions is on our Data & attributions page. If you reuse outputs that contain third-party data, you must follow those terms and attributions.

10. Availability and changes

We aim to keep the Service available and working well but do not promise that it will be uninterrupted or error-free. We may change, add or remove features. If we make a change that significantly reduces what a paid plan provides, we will tell you and you may cancel.

11. Liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
  • Subject to that, we are not liable for any loss of profit, revenue, business, contracts, data or goodwill, or for any indirect or consequential loss.
  • Subject to that, we are not liable for any loss arising from your reliance on an output that has not been checked by a competent hydrologist as required by section 6.
  • Subject to that, our total liability to you in any 12-month period is limited to [liability cap, e.g. the greater of £[amount] and the fees you paid us in that period].

12. Ending your use

You can stop using the Service at any time and ask us to delete your account. We may end these terms or suspend the Service for you as set out in section 5. Sections 6, 8 (feedback), 9, 11 and 13 continue after these terms end. What happens to your data when your account is closed is described in our Privacy Policy.

13. General

  • We may update these terms. We will post changes here and, for material changes, tell you by email at least [30] days in advance. Continuing to use the Service after that means you accept the updated terms.
  • If any part of these terms is found unenforceable, the rest remains in force.
  • These terms, our Privacy Policy and our Cookie Notice are the whole agreement between us about the Service.
  • These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
